In addition to the potential claims and liens noted in the above settlement FAQ, there is an additional step that needs to happen when the settlement is for a person under the age of 18. The settlement monies from the insurance company of the person who caused the injuries are not regularly distributed to a minor. The parent or guardian representing the child must often file a lawsuit with the court and go through a minor settlement hearing. The judge reviews the case and if it is approved, the child’s money gets deposited with the court system. The court, or some financial entity holds this money until the child reaches the age of 18.
