Do Grandparents have custody rights in North Carolina?

Yes, but they are limited. Grandparents with a solid relationship with a child can request custody when parents are ‘unfit’ of have ‘acted contrary to their protected status as parents’. Grandparents can also intervene in a custody case when the family is not ‘intact’.

These situations require legal analysis to determine the ability of a grandparent to be a party in a case, and/or get a share of the child’s custody.
